General Booking Conditions for the Hotel and Catering Industry, according to DEHOGA (German Hotel and Restaurant Association)
1. The guest accommodation contract is concluded as soon as the room has been booked (booking) and confirmed (confirmation). The oral and written form is binding for the confirmation.
2. The conclusion of the guest accommodation contract obliges the contracting parties to fulfil the contract, regardless of the duration of the agreement.
3. The landlord is obligated to pay compensation to the guest in the case of non-provision of the room.
4. The guest is obligated to pay the agreed or customary price, in the case of not using the contractual services, under deduction of the expenses saved by the landlord. The savings are calculated according to the general experience: For accommodation (Fewo) 10 percent, for bed & breakfast 20 percent of the room price, 30 percent for half board, and 40 percent of the boarding price for full board.
5. The landlord is held in good faith, to let unused rooms otherwise in order to avoid financial loss.
6. The guest must pay the amount calculated under clause 4 for the duration of the contract until the room has been assigned to another party.
7. The exclusive place of jurisdiction is the operating location.
